Welcome to Omingle ("Platform," "we," "us," or "our") — a real-time random video, audio, and text chat service that connects adults around the world. These Terms & Conditions ("Terms") are a legally binding agreement between you ("User," "you") and Omingle. Please read them carefully before using any feature of this Platform.

By accessing or using Omingle — whether via browser, mobile device, API, or any other method — you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional guidelines we may post. If you do not agree, you must stop using the Platform immediately.

Omingle is an adult-only platform strictly for users who are 18 years of age or older. By using this Platform, you represent and warrant the following:

• You are at least 18 years old, or the legal age of majority in your country or region — whichever is higher.
• You are legally permitted to access adult-oriented content and platforms under the laws of your jurisdiction.
• You are not using a VPN, proxy, or any method to circumvent geographic or age-based restrictions.
• You are not a registered sex offender, and you have not been convicted of any crime that would prohibit you from accessing this type of content.
• If you are accessing on behalf of another individual, you confirm that individual also meets all eligibility criteria above.

We reserve the right to request age verification at any time and to suspend or terminate accounts that cannot comply.

Omingle may be used with or without a registered account, depending on available features. Whether you register or use the Platform as a guest, the following conditions apply:

Guest Access

• Guest sessions are temporary. No persistent profile is created.
• Guest usage is still subject to all Terms herein.
• We may collect anonymous technical metadata (IP address, device type, session duration) even in guest mode for safety and platform integrity purposes.

Registered Accounts

• You agree to provide accurate, truthful registration information.
• You are solely responsible for maintaining the confidentiality of your login credentials.
• You agree to immediately notify us of any unauthorised use of your account at busineesman717@gmail.com.
• You may not transfer, sell, or share your account with any other person.
• We reserve the right to suspend or terminate accounts that violate these Terms without prior notice.

Omingle is a random-matching communication platform. The core service connects two users anonymously in real-time video, audio, and/or text sessions. You understand and accept the following characteristics of this service:

• Matches are algorithmically random. Omingle does not pre-screen, vet, or approve the individuals you will be paired with.
• Conversations are not moderated in real time by Omingle staff. You use the Report and Disconnect features as your primary safety tools.
• The Platform is provided "as-is." We do not guarantee continuous availability, match quality, or content nature.
• Features of the Platform may be updated, added, or removed at any time without notice.
• Omingle is intended for entertainment and social interaction purposes only. It is not a mental health service, dating service, escort service, or commercial transaction platform.

Every user of Omingle assumes full and sole responsibility for their conduct, content, and interactions on the Platform. Specifically, you agree to:

Conduct Standards

• Treat all other users with dignity and basic respect.
• Engage only in lawful conversations and activities during sessions.
• Exercise personal discretion before sharing any personal information, images, or files.
• Use the Report function promptly when you encounter abusive, illegal, or otherwise inappropriate behaviour.

Personal Data Safety

• Do not share your full legal name, home address, phone number, financial information, government-issued ID, or similar sensitive data in any session.
• Omingle is not responsible for any harm resulting from personal information you voluntarily disclose to other users.

Technical Responsibilities

• You are responsible for your own device, browser, internet connection, and security software.
• You agree not to interfere with the Platform's technical infrastructure, including but not limited to scraping, reverse engineering, or deploying bots.

The following actions are strictly forbidden on Omingle and may result in immediate permanent termination of access, reporting to law enforcement, and/or legal action:

Illegal & Harmful Content

• Sharing, displaying, or soliciting any content that depicts or involves minors in a sexual context — this constitutes child sexual abuse material (CSAM) and will be reported to the National Center for Missing & Exploited Children (NCMEC) and law enforcement without exception.
• Conducting, soliciting, or facilitating any illegal transaction, including but not limited to the sale of drugs, weapons, or stolen goods.
• Sharing content that promotes, glorifies, or incites violence, terrorism, self-harm, or hate speech.

Platform Abuse

• Harassment, stalking, or intimidation of other users.
• Impersonating any person, brand, or authority.
• Spamming, phishing, or distributing malware, viruses, or harmful code.
• Using automated scripts, bots, or any method to artificially inflate usage or disrupt service.

To preserve the privacy and ephemeral nature of conversations, you agree to the following:

• No screenshots, screen recordings, or audio capture of any session are permitted.
• You may not redistribute, publish, or share any portion of a conversation outside the Platform.
• If you become aware that a conversation is being recorded by another party, disconnect immediately and report the user.
• Violation of this policy will result in an immediate, permanent ban and may expose you to legal liability.

The Omingle name, logo, interface design, proprietary algorithms, and all associated branding are the exclusive property of Omingle. You agree not to:

• Copy, modify, or create derivative works of the Platform.
• Decompile, reverse engineer, or attempt to extract source code.
• Use the Omingle trademark or brand assets without prior written consent.

You retain ownership of any original content you create and voluntarily share (text messages, etc.), but you grant Omingle a worldwide, royalty-free license to use, store, and process that content solely for the purpose of operating and improving the Platform.

Our collection and use of personal information is governed by our Privacy Policy. In summary:

• Video and audio streams are not stored or recorded on our servers.
• We collect minimal metadata (IP address, device info, usage logs) for safety, analytics, and platform stability.
• We do not sell your personal data to third-party advertisers.
• We may disclose data if required by law or in response to valid legal requests.

Omingle employs a combination of automated filters and user reporting to identify violations. You acknowledge that:

• Automated systems are not perfect; you may encounter offensive content despite our efforts.
• Reporting a user is the most effective way to trigger a review.
• We reserve the right to review reported sessions and take action at our sole discretion, including terminating connections mid-session.
• We are under no obligation to monitor all activity in real time.

Omingle may integrate with or link to third-party services (e.g., payment processors, analytics providers, or social media). We do not control and are not responsible for the content, privacy practices, or terms of these third parties. Your interactions with any third-party service are solely between you and that service.

• Omingle may display advertisements provided by third-party ad networks.
• You acknowledge that we are not liable for any loss or damage incurred as a result of third-party interactions.

Omingle is a free-to-use platform supported by advertising. By using the Platform, you agree that:

• We may display advertisements, promotions, and sponsored content within the interface.
• We may use non-personally identifiable information to serve contextual or interest-based ads.
• You will not block, hide, or interfere with the display of advertisements except through features we expressly provide (e.g., a premium ad-free subscription, if available).
• Omingle is not responsible for the content of third-party advertisements or any products/services offered through them.

We take violations seriously. Consequences may include:

• Temporary suspension for minor or first-time infractions.
• Permanent ban of your account, IP address, or device fingerprint for severe or repeated violations.
• Reporting to authorities if we believe illegal activity has occurred.

We reserve the right to enforce these Terms at our sole discretion. We are not required to provide a warning before taking action.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. To the fullest extent permitted by law, Omingle disclaims all warranties, express or implied, including but not limited to:

• Merchantability, fitness for a particular purpose, and non-infringement.
• That the Platform will be uninterrupted, secure, or error-free.
• That any defects or errors will be corrected.
• That content from other users is accurate, lawful, or safe.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OMINGLE AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. This includes, without limitation, damages for loss of profits, data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Platform.
• Conduct or content of any third party on the Platform.
• Unauthorized access, use, or alteration of your transmissions or content.

Our total liability to you for any claim arising out of these Terms or your use of the Platform shall not exceed the greater of $100 USD or the amount you have paid us in the past 12 months.

You agree to defend, indemnify, and hold harmless Omingle, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of:

• Your violation of these Terms.
• Your use of the Platform.
• Your violation of any third-party right, including intellectual property or privacy rights.
• Any content you submit, post, or transmit through the Platform.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

Binding Arbitration: Any dispute arising out of or relating to these Terms shall be resolved exclusively through final and binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The arbitration shall be conducted in English and administered by a recognized arbitration provider mutually agreed upon. YOU AGREE TO WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION.

We may modify these Terms at any time. If we make material changes, we will provide notice through the Platform or via email (if available). Your continued use of Omingle after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the new Terms, you must stop using the Platform.

The "Last Updated" date at the top of this page indicates when these Terms were last revised.
